IMPORTANT NOTICE:
Section 17 includes a binding arbitration and class action waiver. If you reside in the United States or your business is based there, this section impacts your rights regarding dispute resolution with Bookyful. Please review it carefully.

1. Acceptance of the Terms

Welcome to Bookyful (“Company, ” “we, ” “our, ” or “us”).
By accessing or using Bookyful.com, the Bookyful App, or any related services (collectively, the “Service”), or by clicking to accept or agree to these Terms when prompted, you confirm that you have read, understood, and agreed to be bound by:

• These Terms of Use, and
• Our Privacy Policy, incorporated herein by reference (together, the “Agreement”).

If you do not agree with this Agreement, you may not access or use our Service. These Terms apply to all users, including those contributing to content or other materials.

The English version of this Agreement governs in case of any translation conflicts. Additional posted rules or guidelines for specific features are also part of this Agreement.

2. Changes to the Terms

Bookyful reserves the right to modify or update these Terms at any time by posting the revised version on Bookyful.com or through the Bookyful App. Your continued use after such posting constitutes your acceptance of the revised Terms. Please review this Agreement periodically for updates.

3. Definitions

• “Coins”: Virtual currency that may be purchased or earned within the Service to unlock or access specific content.
• “Digital Content”: Includes digital comics, books, webtoons, animations, audio, or other creative works available through the Service.
• “Bookyful Website”: https://bookyful.com.
• “Bookyful App”: Our digital reading platform, storefront applications, and related software.
• “User Content” or “User Postings”: Any text, images, graphics, data, or other materials that users upload or share through the Service.

4. Digital Content and Limited License

A. Ownership

All Digital Content available through Bookyful is owned by Bookyful or its licensors. The content is protected by copyright and other intellectual property laws. No ownership rights are transferred to you.

B. Limited License

Bookyful grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Digital Content solely for your personal, non-commercial enjoyment. You may download select content to one device for up to thirty (30) days, after which it will automatically expire.

C. Restrictions

You may not copy, distribute, sell, rent, modify, or create derivative works from any Digital Content. Circumventing any security or copy protection system is strictly prohibited.

5. Use of the Bookyful Website and App

You may use the Bookyful Website and App only as authorized. You may not:

• Separate or redistribute software components,
• Reverse-engineer, decompile, or tamper with security features,
• Transfer your access or software to another user or device.

Bookyful may issue updates or upgrades to maintain the Service. Failure to install updates may result in limited functionality or access.

6. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
Users under 18 (“Minors”) must use the Service under the supervision and consent of a parent or legal guardian.

Bookyful reserves the right to request proof of age or guardian consent and may suspend access for noncompliance.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, available on Bookyful.com, for details on how we collect and use your information. By using the Service, you consent to our data practices as described therein.

Bookyful does not knowingly collect personal information from children under 13 without parental consent. Parents may contact our Customer Care team to request deletion of such data.

8. Intellectual Property Rights

All materials available through Bookyful—including text, images, software, design, and data—are protected by intellectual property laws and are the property of Bookyful or its licensors.
You may not reproduce, modify, distribute, or exploit any part of the Service without prior written consent from Bookyful.

9. Advertisements

Bookyful may display its own or third-party advertisements within the Service. These may include text, graphics, audio, or video and may link to external sites. We are not responsible for the accuracy, safety, or legality of third-party ads or linked content.

10. Obligations of Authors and Publishers

By submitting a literary work for creative design or adaptation:

• You confirm that you own the rights to the work and are legally authorized to create derivative content.
• You are responsible for selecting and collaborating with artists.
• You must secure appropriate licensing agreements governing intellectual property rights.
• You agree to indemnify Bookyful from any claims, losses, or disputes arising from your transactions or content.

11. Obligations of Artists

By registering as an artist on Bookyful:

• You confirm you are of legal age and possess the rights to provide your services.
• You must ensure your work does not infringe on any third-party rights.
• You agree to indemnify Bookyful against claims arising from your work or client interactions.
• You are responsible for maintaining adequate liability insurance.

12. User-Generated Content

Users are solely responsible for any content they upload or share. By submitting content, you confirm that:

• You own or have permission to use the material,
• It does not violate copyright, privacy, or other rights,
• It complies with all applicable laws.

Bookyful reserves the right to remove or disable content that violates these Terms.

13. Purchasing and Using Coins

Coins are virtual items for unlocking content within the Service.

• Coins have no real-world value and cannot be exchanged or transferred.
• All purchases are final unless otherwise required by law.
• Promotional (free) Coins may expire as specified by Bookyful.
• Bookyful may modify or discontinue the Coin system with notice.

14. Suspension or Termination

Bookyful may suspend, limit, or terminate your access to the Service if you breach this Agreement. Upon termination, your license to access content will immediately end.

15. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
Bookyful makes no guarantees regarding uninterrupted access, accuracy, reliability, or security. Your use of the Service is at your own risk.

16. Limitation of Liability

To the maximum extent permitted by law, Bookyful, its affiliates, and partners shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from your use or inability to use the Service.

17. Indemnification

You agree to defend, indemnify, and hold harmless Bookyful and its affiliates from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in thestate or federal courts located in Los Angeles County, California state or federal courts located in Los Angeles County, California, unless otherwise required by law.

19. Arbitration and Class Action Waiver

At Bookyful’s discretion, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, applying California law.
You agree to bring claims only in your individual capacity and not as part of any class or collective action.

20. Entire Agreement and Severability

This Agreement represents the complete understanding between you and Bookyful. If any part of it is found invalid or unenforceable, the remaining sections will continue in full effect.
